These Terms & Conditions are designed to create a clear, professional and enjoyable experience for everyone involved. By booking or engaging Clementine & Taffy for photography, branding, design, marketing, content creation, consulting or other creative services, you agree to the following terms.

1. Booking Confirmation

A booking is not considered confirmed until:

The required booking fee or deposit has been paid.

Any requested paperwork has been completed.

Written confirmation has been issued by Clementine & Taffy.

Dates and project commencement cannot be guaranteed until all booking requirements have been met.

2. Payment Terms

A non-refundable booking fee may be required to secure your booking.

Payment schedules will be outlined on your invoice.

Final galleries, artwork, files, designs or deliverables will not be released until all outstanding invoices have been paid in full.

Creative work will not commence where payment requirements have not been met.

Failure to make payment may result in suspension, postponement or cancellation of services.

3. Late Payments

Invoices not paid by the due date may incur:

A $50 administration fee.

Additional recovery costs where applicable.

Suspension of project work until payment is received.

Clementine & Taffy reserves the right to engage debt recovery services where necessary.

4. Cancellation & Rescheduling

Client Cancellations

Booking fees are non-refundable.

Rescheduling requests should be made as early as possible.

Rescheduling is subject to availability.

Creative Cancellations

In the unlikely event that Clementine & Taffy is unable to perform services due to illness, emergency or unforeseen circumstances, every effort will be made to reschedule or recommend an alternative provider.

5. Weather Policy

For outdoor sessions:

Weather decisions remain at the discretion of Clementine & Taffy.

Light rain, overcast conditions and seasonal weather changes do not automatically trigger a reschedule.

Dangerous weather, severe storms, extreme winds or conditions that may compromise safety or quality may result in postponement.

Weather-related reschedules will not incur additional fees.

6. Client Arrival & Late Attendance

Clients are responsible for arriving on time.

If a client arrives late:

Session time may be shortened accordingly.

Sessions delayed by more than 10 minutes may incur a Late Arrival Fee of $100.

This fee must be paid prior to gallery delivery.

If a client arrives more than 30 minutes late without communication, the session may be considered abandoned and the booking fee forfeited.

7. Travel, Accommodation & Location Costs

Projects outside the Blue Mountains, Western Sydney or agreed service areas may incur additional costs including:

Travel fees

Accommodation

Parking

Tolls

Venue access fees

These expenses will be discussed and approved prior to booking confirmation.

For destination weddings and interstate projects, accommodation may be required at the client’s expense.

8. Client Cooperation

The client agrees to:

Arrive prepared and on time.

Communicate any special requirements prior to the session.

Obtain permissions required by venues or locations.

Supervise children at all times.

Ensure all participants behave respectfully.

Clementine & Taffy is not responsible for missed images due to:

Uncooperative participants

Venue restrictions

Late arrivals

Adverse conditions

Lack of preparation

9. Creative Control

Clients engage Clementine & Taffy for a specific artistic style and creative approach.

The Creative retains full discretion regarding:

Composition

Styling

Posing

Editing

Image selection

Design direction

Final deliverables

Creative judgement is part of the service being purchased.

10. Editing & Deliverables

The final gallery or project will reflect Clementine & Taffy’s established style.

The following are not included unless otherwise agreed:

RAW files

Unedited images

Source files

Working design files

Project drafts beyond the agreed revision rounds

Additional revisions may attract additional fees.

11. Turnaround Times

Estimated delivery timeframes are provided as guides only.

While every effort is made to meet deadlines, turnaround times may vary due to:

Seasonal demand

Project complexity

Illness

Unforeseen circumstances

Clients will be notified of any significant delays.

12. Rush Delivery Requests

Clients requesting delivery faster than the standard turnaround may incur a Rush Editing Fee.

Acceptance of rush requests remains at the discretion of Clementine & Taffy.

13. Copyright & Intellectual Property

All copyright remains the property of Clementine & Taffy unless otherwise agreed in writing.

Clients receive a licence for personal use only.

Images, designs and creative works may not be:

Be re-edited

Have filters applied

Be altered

Be sold

Be submitted for publication

Be used commercially

without written permission.

Commercial licensing can be arranged separately.

14. Social Media & Portfolio Use

Unless a written request for privacy has been made prior to the session, Clementine & Taffy reserves the right to use completed work for:

Portfolio purposes

Website display

Social media

Marketing materials

Industry awards

Publications

Requests for privacy will always be respected where communicated in advance.

15. Model Release & Privacy

Clients may opt out of promotional use of their images by notifying Clementine & Taffy before the session.

Where no request has been made, the Creative may reasonably assume permission for portfolio and marketing purposes.

Private or sensitive sessions will never be shared without consent.

16. File Storage & Backup

Final galleries will remain online for the period advised upon delivery.

Following this period:

Galleries may be archived or removed.

Long-term storage cannot be guaranteed.

Clients are solely responsible for:

Downloading files promptly.

Creating multiple backups.

Maintaining their own archival copies.

While Clementine & Taffy maintains backup systems wherever possible, retrieval of archived files cannot be guaranteed and may attract an archive retrieval fee.

17. Re-Shoot Policy

Re-shoots are not offered for circumstances outside the Creative’s control, including:

Children not cooperating

Individuals refusing photographs

Weather conditions accepted by the client

Clothing choices

Venue restrictions

Personal preferences discovered after delivery

In the unlikely event of a proven technical failure, Clementine & Taffy will determine an appropriate remedy, which may include a partial refund or replacement session.

18. Force Majeure

Neither party shall be held liable for delays or cancellations resulting from circumstances beyond reasonable control including:

Severe weather

Natural disasters

Illness

Government restrictions

Equipment failure

Venue closures

Family emergencies

19. Respectful Behaviour Policy

Clementine & Taffy maintains a safe and respectful working environment.

Abusive, threatening, discriminatory or inappropriate behaviour toward the Creative, assistants, vendors or other participants may result in immediate termination of services.

No refunds will be provided in these circumstances.

20. Limitation of Liability

Liability for any claim arising from services provided shall not exceed the amount paid by the client.

While every reasonable precaution is taken to protect equipment and files, Clementine & Taffy cannot guarantee against events beyond reasonable control.

21. Acceptance of Terms

Payment of an invoice, payment of a booking fee, signing of an agreement, completion of a booking form, or engagement of services constitutes acceptance of these Terms & Conditions.

22. The Dinosaur Clause

Congratulations.

If you are reading this clause, you have officially reached the end of this Terms & Conditions document and are among a very small and distinguished group of clients who actually read these things.

As a token of this achievement, clients who have carefully reviewed this document are warmly invited (though never obligated) to present Rach with one packet of Natural Confectionery Co. Dinosaurs at the completion of services.

For clarity:

The dinosaurs must be the genuine Natural Confectionery Co. variety.

Generic dinosaur lollies, while appreciated, do not carry the same prestige.

Sharing is not guaranteed.

Bringing dinosaurs does not entitle the bearer to additional edits, extra images, discounts, priority delivery, special treatment, or any form of creative bribery.

Failure to provide dinosaurs will not affect your booking, your gallery, your delivered files, your standing in the community, or your ability to sleep peacefully at night.

However, mentioning this clause at any point during your project will instantly reveal that you are one of the rare and wonderful people who actually read Terms & Condition.
